The Brazilian senate has given up on its data protection bill to embrace the more advanced and more consensual bill approved by the lower house.
The bills were the subject of a public hearing on Tuesday. The rapporteur of the senate bill, senator Ricardo Ferraço, announced that the lower house text would be prioritized after calls from representatives of the academic, industrial, services, retail and consumer protection sectors.
At the end of May, the lower house passed a bill regulating the handling of citizens' personal data by the public sector and private entities and the text was due to be discussed and voted on by the senate.
Ferraço said he would work to have the bill passed by the senate economic affairs committee next week so it could be put to a vote by the full house before the parliamentary recess in July.
The lower house text is backed by ICT companies, national industry federation CNI and digital rights experts, among others. However, the financial sector has made calls for it to be watered down somewhat, especially regarding consent issues.
The approved bill is in line with the European GDPR regulation, requiring specific and clear consent by citizens for the use of their data and on the use of data for commercial and targeted marketing purposes.
The Brazilian law will apply even to companies headquartered outside the country, as long as the data processed concerns individuals in Brazilian territory or if the personal data was collected in Brazil.
